After a loved one dies, it can be hard to know what to do first and what to do next. Probate is the process of disbursing your loved one’s property and ensuring that their wishes are carried out. Whether your loved one had a will or not, Van Pelt Law can help you through the process smoothly and efficiently.


What to do when a loved one passes

Immediate actions:

  • Get a legal pronouncement of death.

  • Arrange for transportation of the body.

  • Notify your loved one’s doctor or the county coroner, their close family and friends, and the their employer (if they were working).

  • Make arrangements for your loved one’s dependents and pets.

Within a few days after death:

  • Arrange for funeral or memorial, and burial, cremation, or composting of the body.

  • Ask a friend or family member to go with you to the mortuary to say good-bye.

  • Prepare an obituary.

  • If your loved one was in the military or belonged to a fraternal or religious group, contact the organization. It may have burial benefits or conduct funeral services.

  • Ask a friend or relative to keep an eye on your loved one’s home, answer the phone, collect, the mail, throw food out, and water the plants.

Within 10 days of death:

  • Obtain death certificates (usually from the funeral home). Get multiple copies — at least 10.

  • Contact a probate attorney
